All delivery agreements must be made in writing. Either by e-mail or letter. Delivery periods begin with the date of the order. All delivery obligations are subject to our own punctual delivery. Partial deliveries and partial services are permissible.
In the case of supply contracts, each partial delivery and partial performance shall be deemed an independent performance. If the delivery deadline is not met, the buyer is entitled and obliged to set the seller a grace period of 4 weeks.
Delay in delivery shall not occur in the event of force majeure or due to events which make delivery substantially more difficult or impossible for the Seller. This includes all operational disruptions, force majeure and strikes etc., regardless of whether these occur in the supplier´s own business, that of the supplier or subcontractors. In these cases, the buyer cannot claim any damage caused by delay or compensation for non-performance.
Elisabeth Kreuzer is entitled to postpone the delivery or service for the duration of the hindrance plus a period of 2 months or to withdraw from the contract in whole or in part because of the part not yet fulfilled in the event of delivery or service delays for which she is not responsible.
If the delay in delivery and performance lasts longer than 2 months, the buyer is entitled to withdraw from the contract with regard to the part not yet fulfilled. If the delivery period is extended and for reasons for which Elisabeth Kreuzer is not responsible, the purchaser may derive claims for damages from this. Elisabeth Kreuzer can only invoke the aforementioned circumstances if she immediately notifies the customer in writing.
If Elisabeth Kreuzer is responsible for a delay in delivery, merchants only have the right to withdraw from the contract to the exclusion of claims for damages.
